In order for a video deposition taken under oath to be admissible as evidence certain protocols always have to be followed. When I first started as a deposition videographer videotape and DVD were the popular delivery and viewing formats. That has changed in popularity to digital video files, but the same recording protocols have to be met for announcements. And to record the deposition on record and to go off the record the correct ways.

The two most commonly used terms for a deposition videographer are a certified deposition videographer or specialist. It’s critical to have a good legal video education and applied experience as a professional videographer. Two schools for legal video include: The American Guild of Court Videographers (AGCV) and he NCRA, National Court Reporters Association.

Prior to forming Mister Photon Media, I also worked for a consulting company for years creating graphics for trial presentations, litigation and other needs. As well providing legal video services to the firms clients.  I can create trial presentations and graphics for clients to scale, and with accuracy. Many law firms use certified deposition videographers (CDVS) to record a witness or deponent’s testimony.

Procedures

Deposition video is used in a trial presentation or for discovery to evaluate a witness. I record depositions following the guidelines of federal evidence and civil procedure. Ensuring your video deposition is admissible as evidence is done by a certified legal videographer. Depositions are recorded for discovery that often leads to a settlement, lack of litigation (claim withdrawal), or trial. Many other legal video services include site documentation, video documentation for day in the life or life after life, or for trial presentation. Or for other video documentations for legal needs, conveyance or other use.

Mister Photon Media also creates video for advertising, TV or other needs. Photography can be used for insurance claims, law firm discovery, advertising or other needs.

Also making graphics and animated videos can integrate GIS data, aerial photographs, historical or current data, site surveys among other procedures. These graphics can be used for trial presentation or for other needs legal or for other purporse.

Graphics, animation and trial presentations are also a service I provide.

Why Not Zoom or Other Service?

As far as admissible video depositions. Video frames and audio are often dropped making a deposition inadmissible to the court if poorly connected. Or if connection issues occur, re-asking/answering questions is required which can create inconsistency. 

Recording witness testimony with professional cameras and audio equipment is a must for clear audio & picture. This surpasses laptop technology but zoom and other portals can enhance a deposition.  The equipment and videographer are required for several reasons past the zoom or video conference to be allowed as evidence.

Better cameras, sound equipment and a certified video deposition specialist will ensure an admissible video deposition for evidence. You can always use Zoom or other conference portal, even a phone call, with the CDVS recording the witness. The ambient sound often drowns out zoom or streaming technology either making it difficult to hear or very noisy.

I can also  bring laptops for Zoom or other meeting connections to help communication. These technologies are great for communication, but not ideal as a stand-alone solution. Relying on a zoom recording or other similar technology can be risky if the WiFi is bogged down by users or not fast enough. Hire a certified deposition videographer or legal videographer to help with your discovery. Connection issues can arise from either end from plaintiff or defense.

Day in the Life Video

Settlement Video, AKA, Video Documentation

This is an example of a day in the life legal video. Also called a settlement video or a video documentation. This video depicts how a suggested unneeded back surgery poorly impacted a patient’s quality of life permanently. This video was used to settle a medical malpractice lawsuit by a hiring attorney.

Accident Reconstruction Video, Litigation
Example Forensic Animation
Part 1, plane taking off.

This is the first part of an accident reconstruction depicting the Boeing 737 Max airliner. These types of animations can be used for accident demonstration or other recreations of events. Sometimes these animations are referred to as forensic animations or a video animation.

Part 2, plane crash reconstruction

This is the second part of the prior animation showing a Boeing 737 Max airliner taking off then crashing due to a nosedive. These types of 3D animations can be used for accident recreation of events or to depict a possible future or even for demonstration for engineering and design.

Conveyance Dispute Trial Presentation

This is an animated video using GIS & CAD data to create a trial presentation showing details of a property. The litigation settled before the trial presentation was used in a trial.

 

First Draft, Mine Tailings 
Decant Pond Accident Recreation

This is a 1st draft for client approval demonstrating a mine tailing pond accident where a portion of the retaining area failed. Mine tailings are not typically blue, but this color was chosen for contrast against to the decant pond. We produce other types of accident reconstructions for clients.

Product Liability Dispute Animation
Negligence Dispute

This is a 3D animation demonstrating a “defective product” dispute where a frayed electric cord came in contact with liquid. Dispensed from a coffee maker that was overfilled with water, causing electric shock to the plaintiff. These types of trial presentation video can be used for settlement or a trial presentation to supplement trial exhibits or graphics.

Sea Wall Removal & Ground Remediation

This is a series of GIS rendering showing how a former refinery’s subsoil would be removed due to a petroleum storage tank leaking. Upon discovery the refinery placed a retaining wall to keep the petroleum from leaking into the ocean. Then came up with a plan to remove all the soil and turn the location into a beach access area for the public.

Mister Photon Media can also create architectural renderings, GIS and terrain models rendered and videos animated for clients.

& Regulatory Compliance Animation

This is a 3D animation using GIS data and air photos to show a mining property’s boundaries. Also monitoring well locations for regulatory compliance as well overall features for a presentation.
